These Terms of Service ("Terms") are a binding agreement between you and Tosemum Holdings LLC, Arizona, USA ("Wylde," "we," "us"). By creating an account or using the Wylde app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Wylde.
Wylde is an introduction platform that helps adults connect around shared physical activities. Wylde is not a background-checking, vetting, or chaperone service.
WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR OTHERWISE VET USERS. WE DO NOT VERIFY THE IDENTITY, STATEMENTS, PHOTOS, OR INTENTIONS OF ANY USER. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS, ONLINE AND OFFLINE.
You must be at least 18 years old to use Wylde. By using Wylde you represent that you are 18 or older, legally able to enter this agreement, and have not previously been removed from Wylde for violating these Terms. Wylde is intended for personal, non-commercial use.
Wylde's purpose is to help people meet in real life for physical activities. Physical activity and meeting people you do not know both carry inherent risks, including the risk of injury, property damage, or harm caused by other people.
BY USING WYLDE, YOU VOLUNTARILY ASSUME ALL RISKS ARISING FROM (A) MEETING OR INTERACTING WITH OTHER USERS IN PERSON, AND (B) PARTICIPATING IN ANY PHYSICAL ACTIVITY ARRANGED THROUGH OR RELATED TO WYLDE. WE DO NOT ORGANIZE, SUPERVISE, HOST, OR CONTROL MEETINGS OR ACTIVITIES BETWEEN USERS, AND WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OR FOR ANYTHING THAT OCCURS DURING OR AFTER AN IN-PERSON MEETING.
Use good judgment: meet in public, tell someone where you're going, arrange your own transportation, and review the in-app Safety Tips. Consult a physician before beginning any physical activity if appropriate for you.
You are responsible for your login credentials and all activity on your account. Provide accurate information, including your real date of birth. You may delete your account at any time in Settings → Account → Delete account.
You agree not to:
You keep ownership of the content you post (photos, bio, messages). You grant Wylde a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content solely to operate and improve the service. You represent that you have the right to post what you post. We may remove content that violates these Terms.
Wylde provides blocking, reporting, and safety information. We review reports and may warn, restrict, suspend, or remove accounts at our discretion. We do not commit to monitoring all content and are not liable for user content or conduct, but we reserve the right to act on it.
Wylde is currently free. If paid features are introduced, additional terms and store billing rules (Apple App Store / Google Play) will apply and will be presented before purchase.
Your download and use of the app is also subject to the Apple App Store or Google Play terms. For iOS users: these Terms are between you and Tosemum Holdings LLC, not Apple; Apple has no obligation to provide support or maintenance; and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
WYLDE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOU WILL RECEIVE MATCHES, THAT USERS ARE WHO THEY CLAIM TO BE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOSEMUM HOLDINGS LLC AND ITS OFFICERS, MEMBERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM THE CONDUCT OF USERS OR IN-PERSON MEETINGS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) US $100 OR (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Tosemum Holdings LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of Wylde, your interactions with other users, or your violation of these Terms or of law.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Except for small-claims matters and requests for injunctive relief, any dispute arising out of these Terms or Wylde will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Maricopa County, Arizona or remotely.
YOU AND WYLDE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
Opt-out: you may opt out of arbitration by emailing legal@wyldeapp.com within 30 days of first accepting these Terms, with your account email and a statement that you opt out.
You may stop using Wylde or delete your account at any time. We may suspend or terminate your access at any time for violation of these Terms or to protect users or the service. Sections 4, 7, and 11–14 survive termination.
We may update these Terms. If changes are material, we will notify you in the app or by email before they take effect. Continued use after the effective date means you accept the updated Terms.
If any provision is found unenforceable, the rest remain in effect. These Terms are the entire agreement between you and us regarding Wylde. We may assign these Terms; you may not without our consent. Our failure to enforce a provision is not a waiver.
